The Deal

Onehoursitefix.com is a trading name of OneHourSiteFix Limited whose registered address is 127 City Road, London EC1V 2NX with company registration number 09362914. VAT number : GB235684585. OneHourSiteFix for protection of website also uses the services of SharkGate Oy (www.sharkgate.net). All terms and conditions that refer to any OneHourSiteFix service also apply to any service we offer that is provided bySharkGate Oy.

We are old and wise enough to know we can’t predict the future and that we are not perfect. We will do our very best, and our customers tell us that is really pretty good, but we can not guarantee that nothing will ever go wrong or that we will never make a mistake or that a hacker somewhere in the world one day gets the better of us – temporarily. What we will guarantee is that we will work extremely hard to provide you with the very best possible service to make the internet a safer place to do business for you and all our customers.

This is the deal you are agreeing to when you sign up to use OneHourSiteFix services:

the Payment and Contract Stuff

If you have signed up at OneHourSiteFix (www.onehoursitefix.com) for one of ours website protection packages plan you have signed up for a continuous subscription which will automatically renew, and that the price of your selected subscription plan level and/or add-on(s) will be billed to your designated payment method as a recurring charge for the period (monthly, quarterly, half-yearly or yearly). Unless you cancel your subscription(s), through your subscription dashboard, before the beginning of your next billing period. You will be billed for the full period in which you cancel and no refunds will be given. By purchasing a subscription, you agree to a minimum of one period (monthly, quarterly, half-yearly or yearly) purchase obligation. We don’t believe in making it almost impossible to cancel if you are unhappy with what we do. We believe in keeping you happy so you don’t want to cancel in the first place.

If one of your period payments fails because there is no money in your account or for any other reason we won’t cancel your service without first telling you and giving you two weeks to get your account in order.

If we decide to increase our prices we will tell you at least 30 days in advance giving you plenty of time to decide if you wish to accept the new price or not.

Our service is designed for small to medium sized businesses which is why our prices are so competitive. If your website attracts a huge amount of traffic we may decline to accept you as a customer. If this is the case we will contact you immediately and offer you a choice of our Enterprise Level service or an immediate refund of any money that we owe you with no quibble and no ‘administrative’ charges.

We reserve the right to stop providing our service to you for any reason and at any time. We need to reserve this right to mainly to protect ourselves from customers who might be tempted to publish illegal content on websites protected by OneHourSiteFix Ltd or SharkGate Oy. If we do have to do this we will of course refund any money that we own you with no quibble.

Extra Legal Parts (that by signing up to any of our services you give full agreement to)

Indemnification – Client agrees to indemnify, defend and hold OneHourSiteFix Ltd, SharkGate Oy, its officers, directors, employees, stockholders, affiliates, agents and suppliers, from and against any and all third party claims and the related damages, losses or expenses, including but not limited to attorneys’ fees and costs, arising out of or in any way connected with Client’s Content or websites, including without limitation any claims relating to the accessibility of Client’s website and any collection, use, or export of personal information or other data.

Additional Service Notes – OneHourSiteFix Ltd and SharkGate Oy are not a back-up services and so do not keep a copy of Client’s Content. They also does not keep a backup copy of any malicious files cleaned or removed from a Client’s site or servers

Refund Policy. Customer may be eligible for a refund of some or all subscription fees in the event OneHourSiteFix, SharkGate Limited Services fail to perform, as determined solely by OneHourSiteFix, SharkGate Limited, or in the event of early discontinuation of unused pre-paid Services by OneHourSiteFix, SharkGate Limited. Any refund request must be made, in writing including the reasons for the refund, within thirty (30) days of signing up for the Services. In the event of a refund, OneHourSiteFix, SharkGate Limited may not be able to refund any taxes that Customer paid. OneHourSiteFix, SharkGate Limited will use commercially reasonable efforts to refund promptly any charges (less any amounts that Customer owes) to customer. This Refund Policy shall not apply if Customer is found to be in violation of OneHourSiteFix, SharkGate Limited terms of service.

Limitation of Liability – IN NO EVENT SHALL ONEHOURSITEFIX LTD, SHARKGATE OY, VENDORS OR SUPPLIERS HAVE ANY LIABILITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, INCOME, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, WHETHER IN CONTRACT, TORT OR UNDER ANY THEORY OF LIABILITY EVEN IF ONEHOURSITEFIX LTD OR SHARKGATE OY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE TOTAL AND AGGREGATE LIABILITY OF ONEHOURSITEFIX LTD, SHARKGATE OY, VENDORS AND THEIR AFFILIATES AND SUPPLIERS TO CLIENT OR ANY THIRD PARTY SHALL BE LIMITED TO THE AMOUNT OF FEES PAID BY CLIENT FOR THE SERVICES DURING THE ONE (1) MONTH PERIOD PRECEDING THE EVENT THAT GAVE RISE TO THE CLAIM. CLIENT ACKNOWLEDGES AND AGREES THAT ONEHOURSITEFIX/SHARKGATE LIMITED AND VENDOR HAVE OFFERED THE SERVICES AND SET THEIR PRICES IN RELIANCE UPON THE WARRANTY DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH HEREIN, THAT THE WARRANTY DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH HEREIN REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK, AND THAT THE WARRANTY DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH HEREIN FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN CLIENT, VENDOR AND ONEHOURSITEFIX LTD OR SHARKGATE OY. ONEHOURSITEFIX LTD OR SHARKGATE OY WOULD NOT BE ABLE TO PROVIDE THE SERVICES ON AN ECONOMICALLY REASONABLE BASIS WITHOUT THESE LIMITATIONS.

Disclaimers – ONEHOURSITEFIX LTD , SHARKGATE OY AND ANY OF ITS VENDORS OR SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND WITH RESPECT TO THE SERVICES , WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT AND ANY EXPRESSED OR IMPLIED WARRANTIES ARISING FROM ANY COURSE OF DEALING, USAGE, OR TRADE PRACTICE. ONEHOURSITEFIX LTD OR SHARKGATE OY MAKE NO WARRANTY THAT: 1. THE SERVICES WILL MEET CLIENT’S REQUIREMENTS OR EXPECTATIONS; 2. THE APPLICABLE SITE TO WHICH CLIENT’S TRAFFIC IS ROUTED WILL BE AVAILABLE AT ALL TIMES, UNINTERRUPTED OR FREE FROM DOWNTIME OR INOPERABILITY; OR 3. THE SERVICES WILL WITHSTAND ATTEMPTS TO EVADE SECURITY MECHANISMS OR THAT THERE WILL BE NO BREACH OF THE SERVICES’ SECURITY MEASURES.
